What is Delta 8 THC?
Cannabis (scientifically known as Cannabis sativa) is a complex botanical species that has been cultivated for thousands of years for a variety of uses. Its extracts have been studied worldwide for their incredible therapeutic properties, while some strains are exclusively grown for their mind-altering (“high”) effects. In the modern day, it serves another purpose: industrial hemp is grown for resilient fibers to be used in clothing and construction materials; seeds for nutrition, and oils for cosmetics and food.
Both marijuana and hemp plants are varieties of the Cannabis sativa plant species; they are just cultivated differently and have distinct chemical compositions. Marijuana plants are bred for their high tetrahydrocannabinol (THC) content — the primary psychoactive compound in cannabis. Hemp plants, on the other hand, are classified as cannabis that contains 0.3% or less THC by dry weight. This was further emphasized in the 2018 U.S. Farm Bill which legalized hemp on the federal level. Hemp is not used for recreational purposes because its THC content is too low to produce psychoactive effects.
Delta 8 THC occurs naturally in both marijuana and hemp plants, but only in very small amounts. Because of its trace levels, extracting D8 directly from cannabis in a cost-effective and sufficient quantity is simply not feasible. Therefore, most commercially available D8 THC is derived from hemp-extracted CBD (Cannabidiol).
The way it works is, CBD extracted from legally grown hemp plant is chemically converted into Delta 8 through a synthesis process. This makes it yield Delta 8 THC distillate in larger quantities that is then infused into a wide range of products.

Enzymes are responsible for breaking down endocannabinoids and cannabinoids once they have carried out their function.

Is Delta 8 THC Legal?
Under the 2018 Farm Bill, hemp and hemp-derived cannabinoids, were federally legalized in the United States, provided that the dry weight of these products contains less than 0.3% Delta 9 THC. Since Delta 8 can be synthesized from CBD derived from legally-grown hemp, it is, thus, federally legal.
That said, individual states have the authority to set their own rules regarding the legal status of Delta 8 THC. For example, as of 2024, D8 is strictly prohibited in Alaska, Arizona, Arkansas, California, Colorado, Delaware, New York, and Washington, to name a few. But if you live in West Virginia, Ohio, Tennessee, Pennsylvania, Virginia, North Carolina, South Carolina, or Indiana, D8 is legal to buy and consume, as long as it’s derived from federally-compliant hemp.
Keep in mind that state laws are changing frequently, so check the cannabis regulations in your state before purchasing Delta 8 products. Also, if your job conducts random drug tests, proceed with caution.
